How to be a medical cannabis caregiver in West Virginia
Some patients choose to have – or are required to have – a designated caregiver who can purchase cannabis on their behalf. They’re also allowed to transport it and prepare it for patient use.
In West Virginia, a caregiver must be designated by the patient or their legal guardian using the West Virginia Caregiver Designation Form, pay the state’s application fee, and submit a criminal history background check. The application will be denied if the designated caregiver has a history of drug abuse, felony possession, sale of controlled substances or drug-related conspiracy.
To qualify as your caregiver, they must:
- be responsible for the management of the wellbeing of the registered patient concerning their palliative use of cannabis,
- be at least 21 years of age, although the OMC has the latitude to make exceptions in extremely rare circumstances,
- for patients under 18 years of age, be a parent or guardian unless it can be demonstrated that “no parent or legal guardian is appropriate or available.”
Caregivers cannot:
- use the patient’s cannabis,
- be the patient’s doctor,
- purchase more than the maximum amount allowed for the patient.
The caregiver application fee is $50. The fee may be waived if the caregiver can demonstrate financial hardship.
