My state has recreational cannabis, so why would I need a medical card?

Medical marijuana patients have several benefits that recreational users don't. Recreational states like California tailor their laws to make access more affordable and convenient for medical cannabis patients. These benefits include:

  1. No State Sales and Use Tax (Revenue and Tax Code 34011) 

    Prop 64 adds language to section 34011 providing a tax break for medical patients with a state-issued MMIC. Local and excise taxes will still apply, but it's a substantial discount.

  2. Parental rights protection (Health and Safety Code 11362.84)

    Patients legally using medical marijuana in California can no longer have their children removed just because they use cannabis.

  3. Right to carry more than an ounce (Health and Safety Code 11362.71(e))

    Medical marijuana patients have the right to possess as much cannabis as their doctor says they need. The state sets a standard limit of 8 ounces of dried cannabis, but the doctor can set that limit higher if it is reasonable. This is far more than the ounce that recreational users are allowed to possess. Of course, a patient might still be arrested if law enforcement believes they're violating any other law, but probable cause is required for such an arrest.

  4. More retail choices and delivery options

    Many cities and counties in California still ban all recreational sales, but some of those still allow medical cannabis. You'll need a card to access these medical-only dispensaries.

  5. More product choices

    Because you can access more dispensaries with a card, you'll also have more choices for products. Medical patients can also purchase more potent edibles than recreational patients. Need an exotic or hard-to-find strain? You'll have a better chance of finding it with a medical card.

  6. You can cultivate more plants in some jurisdictions

    Some municipalities are attempting to only allow cultivation of six plants, regardless of patient status. But most allow medical patients to cultivate more with a medical card. In some cities, only medical patients are allowed to cultivate outdoors. The advantages will depend on your specific location, but it's worth looking in to!

  7. The only legal option for those under 21

    It's still against the law to purchase, possess or use recreational cannabis if you're under 21 and don't have a medical recommendation.

What is a medical marijuana recommendation & Why do I need one?

Prop 215's critics still argue that its language is too permissive because it allows doctors to provide cannabis for what they see as mild conditions like headaches or stress. But this was just what initiative co-author Denis Peron wanted. After the initiative passed, Peron said "I believe all marijuana use is medical--except for kids." He probably couldn't have predicted that the first FDA approved cannabis use would be for Epidiolex to treat childhood seizure disorders.

As a result, tens of thousands of drug convictions were for a substance that has not killed a single person, while very harmful drugs circulated undetected. The US prison population exploded while violent gang activity reached every corner of the nation.

Now, the United States has the world's largest prison population--not per capita--but actually the most people in prison anywhere in the world. Our population is roughly 325 million, but we have over 
2.12 million prisoners. Even China has less prisoners than us at a mere 1.65 million, even though they have four times our population. This is a very sad distinction to hold, and most experts agree that cannabis prohibition and the War on Drugs is the main underlying cause.

The passage of
 Prop 215 was the nation's first step toward ending cannabis prohibition. Now, just a couple of decades after a small group of activists convinced California to legalize cannabis as medicine, we have legal medical cannabis in 33 states and 10 states and DC. More are joining the fold every year.
Even more encouraging is the 
federal government's decision to reschedule CBD from Schedule 1 to Schedule 5. As a non-psychoactive compound, it should be completely de-scheduled, but the feds will probably be the last to admit their prohibition mistakes.

Obtaining a medical marijuana recommendation is more convenient now too! Modern tablets, PCs and smartphones give patients the option to use telehealth. A telemedicine visit still offers the same excellent service and care, just without the inconvenient drive and wait. In fact, a set of guidelines was released by the 
Federation of State Medical Boards in 2014 to "remove regulatory barriers to widespread appropriate adoption of telemedicine technologies for delivering care." Both telehealth and cannabis were among the top five most important medical regulatory topics in 2016.

A few states, like New York and Nevada, call for a two-way video teleconference when recommending cannabis. Others, like California, allow patients and doctors to complete interviews over the phone if necessary. Whichever option the patient uses for their evaluation, anf electronic copy of their doctor's recommendation will be delivered through email while the physical copy is delivered in the mail.
