How to Get a Medical Marijuana Card in New York

About Medical Marijuana in New York

Governor Cuomo signed New York's Compassionate Care Act (S7923) in July, 2014. This program authorizes registered patients in the state to purchase and possess marijuana provided by registered dispensaries. Unlike California, in order to participate in New York's medical marijuana program, patients are required to register with the state and be approved first.

Physicians who want to register patients for medical marijuana must take educational courses about how the medical marijuana program works and how medical marijuana is used. Once the physician has completed their qualifying education, they may recommend cannabis to patients with qualifying conditions that they are qualified to treat.

Once the physician has recommended cannabis, they must provide the exact dosage of cannabis they recommend for the patient and provide continuous care.

Qualifying Conditions

A patient must have one of the severe, debilitating or life-threatening conditions on New York's list of qualifying conditions.
The qualifying conditions are:

  • HIV or AIDS
  • Parkinson's disease
  • Amyotrophic Lateral Sclerosis (ALS)
  • Cancer
  • Multiple Sclerosis
  • Epilepsy
  • Spinal Cord Injury with Spacticity
  • Inflammatory Bowel Disease
  • Huntington's Disease
  • Neuropathy
  • Post-Traumatic Stress Disorder
  • Chronic Pain
  • Any condition for which an opioid could be prescribed

In addition, the patient must have at least one of the following complicating conditions:

  • Severe or chronic pain
  • Cachexia or wasting syndrome

  • Severe or persistent muscle spasms

  • Opioid use disorder

How to Become a Medical Cannabis Patient in New York

Becoming a medical cannabis patient in New York is easy. There are just a few simple steps. First, you sign up with NuggMD's easy process, then you chat with your new doctor. Once you're approved and receive your emailed certification, sign up with New York's State Registry at

How to Register as a Caregiver in New York

In New York, and certified patient can designate up to two caregivers to help them with purchasing and administering medical marijuana. A person can be designated as a caregiver if they are 21 or older, are a resident of New York, and are not the physician that certified the patient.

A caregiver can register with New York once the patient's application is approved by the state. A caregiver is not allowed to assume their duties until they receive their approval and Registry ID card from the state. There is a $50 fee for the application, but the Department currently waives this fee for both patients and designated caregivers.

How to Renew Your Registry ID

You must be re-certified by a physician before you can renew your registration. Any qualified, New York licensed physician can provide this re-certification. Please note that you can't purchase medical marijuana with an expired Registry ID, so you should plan to see a doctor for recertification before your current Registry ID is set to expire.

Your certification will usually last for one year, but doctors have the ability to set a shorter timeline if they feel that a one year certification is not warranted. If you have a caregiver, they may not recertify until you have recertified first and received Department approval.

The good news is the recertification process is extremely easy. You'll simply enter your new registration number and answer a couple of yes/no questions.

Patient Possession/Purchase/Cultivation Limits

Patients are not allowed to cultivate cannabis in New York. Only registered organizations can grow, process and sell cannabis and cannabis products.

Your purchase/possession limits are entirely up to your physician. In this sense, New York is very different from other states. Doctors provide precise brand, administration methods and product requirements on recommendations, much like one sees with a prescription at a pharmacy.

New York has the largest population on the East Coast, most of it in New York City's five boroughs, but not the largest number of cannabis patients. Florida holds that crown. Florida has roughly a quarter million patients vs. New York, which has just over 100,000. The program is growing rapidly though, and the state is working toward full recreational legalization.

How much does cannabis cost at New York dispensaries?

The Health Commissioner has control over cannabis prices at New York dispensaries. The dispensaries propose the prices, but they are subject to approval. That being said, prices in New York are generally about double the prices on the West Coast.

What if I'm not a permanent New York resident? Can I still get a card?

If you're staying in New York on a temporary basis and need to use cannabis while you're there, you can sign up as a temporary patient. You will have to see a New York medical marijuana doctor in order to be approved, and the process takes a few days, so you should plan ahead. You will be required to show temporary proof of residency such as a rental agreement or utility bill (not a cell phone bill), and the certification will only be valid for the length of your stay.

Am I still subject to drug testing if I become a certified cannabis patient?

New York City has outlawed pre-employment testing for THC, but there are exceptions for people who are in certain types of safety-sensitive or government jobs. These people will still be subject to testing for THC, and so will people who live and work outside of New York City.

Can my parental rights be affected if I become a cannabis patient?

Yes they can. New York doesn't have specific protections for parents who are also cannabis patients like California does. There are efforts to add protections in New York City, but for the most part, you must consider your parental rights very seriously before you consider using cannabis in New York.

Can a patient renew their certification before their ID card expires?

Absolutely. As a matter of fact, it's a good idea to schedule your re-certification evaluation a few weeks before your current one expires.
