  • Chronic nausea or cyclical vomiting syndrome that has proven resistant to other conventional medical treatments;
  • Post-traumatic stress disorder; and
  • Any other medical condition or disease for which the Kentucky Center for Cannabis established in KRS 164.983, or its successor, determines that sufficient scientific data and evidence exists to demonstrate that an individual diagnosed with that condition or disease is likely to receive medical, therapeutic, or palliative benefits from the use of medicinal cannabis;

How to be a medical cannabis caregiver in Kentucky

Kentucky's executive order allows caregivers to procure and administer cannabis to a patient so long as they are:

  • at least 21 years old, 
  • responsible for managing a significant measure of the patient's well-being, 
  • in possession of a written document showing that they are the caregiver.

In Kentucky, your physician must authorize the use of a caregiver. Should you need one, your physician will provide written documentation that states this need and the name of your caregiver, along with your written recommendation. This document isn't necessary if the caregiver is the patient's parent or legal guardian.

Caregivers cannot:

  • use the patient’s cannabis,
  • possess more than the maximum amount of cannabis allowed in the jurisdiction where the cannabis was purchased
  • possess cannabis without proof of legal purchase, such as a receipt from the dispensary

How to register for a med card in Kentucky

Kentucky doesn't have a functional medical marijuana program yet, so there is no medical marijuana card to register for in the state. At the moment, if a resident or visitor to Kentucky has cannabis under the following conditions, they will receive a full pardon if charged:

  • They must be in possession of a physician's recommendation for medical marijuana from a Kentucky doctor or a physician from their state of residence who is in good standing.
  • They must have a receipt that shows they purchased their cannabis from a legal source. 
  • They must be in possession of no more than the legal maximum purchase amount allowed in the jurisdiction from which they purchased the cannabis, up to and not to exceed 8 ounces. 

On March 30, Governor Beshear signed SB 47 into law. Once the program is fully implemented, the state will be issuing medical marijuana cards.

How to renew your med card in Kentucky

At the moment, the state isn't issuing registry identification cards. Once they begin, Registry Identification Cards will be good for one year from date of issuance. Your initial evaluation must be in the physical presence of the doctor, but follow-up evaluations can be conducted via telemedicine if the physician thinks it's appropriate.

  • There isn't a functioning medical marijuana program in Kentucky yet. However, patients or their caregivers who are in possession of a valid physician's recommendation and a receipt to show the legal purchase of their cannabis are granted a full pardon via Governor Beshear's executive order.

    This pardon only applies to possession of cannabis within the precise parameters of the order. Anyone who does not have a valid recommendation, or is in possession of more than the allowed amount, or is attempting to distribute cannabis illegally will not be granted a pardon.

    Once the state begins issuing Registry Identification Cards, patients will be required to register with the state to continue to legally possess and use medical cannabis.

  • Here is the full list of qualifying conditions for medical marijuana in Kentucky:

    • Any type or form of cancer regardless of stage;
    • Chronic, severe, intractable, or debilitating pain;
    • Epilepsy or any other intractable seizure disorder;
    • Multiple sclerosis, muscle spasms, or spasticity;
    • Chronic nausea or cyclical vomiting syndrome that has proven resistant to other conventional medical treatments;
    • Post-traumatic stress disorder; and
    • Any other medical condition or disease for which the Kentucky Center for Cannabis established in KRS 164.983, or its successor, determines that sufficient scientific data and evidence exists to demonstrate that an individual diagnosed with that condition or disease is likely to receive medical, therapeutic, or palliative benefits from the use of medicinal cannabis;
  • There is a committee that will add new conditions as they are found to be appropriate, although Kentucky's list of qualifying conditions is very broad and inclusive and includes chronic pain.

  • Kentucky doesn't have a medical marijuana program or issue med cards yet. SB 47, which was signed by Governor Beshear on March 30, will see the development of a full program. Meanwhile, a physician's recommendation is required for a patient to receive a pardon should they be arrested for possession of cannabis.

  • The cost of a medical marijuana card in Kentucky hasn't been established yet.

  • There is no insurance coverage for the plant yet. In the future, this will likely change once cannabis is fully legalized at a national level. Until then, insurance won't cover it.

  • Since there is no way to register yet with the state of Kentucky. A program will be established soon.

  • This depends on the state to which you’re traveling. Each state has different rules regarding reciprocity, and some don’t allow it at all. If the state you're traveling to requires a state-issued card, then your recommendation won't suffice. However, some states only require a doctor's recommendation. Check with your destination state to learn more.

  • Kentucky state doesn't offer MMJ IDs yet, but they will very soon.
