As of 2022, the consumption of cannabis is not legal for medicinal or recreational use in the state of Indiana. The state of Indiana first banned cannabis in 1913 unless you obtained a prescription. One hundred years later, in 2013, the state failed to pass a bill that would have decriminalized small amounts and even attempted to increase penalties for possession. Two years later, in 2015, there were two different attempts to legalize the sale of medical marijuana, but they, unfortunately, failed to advance further. Governor Eric Holcomb legalized the use of CBD oil that contains less than 0.3% THC for epilepsy in 2017, and in 2018 the law was expanded to allow the sale of CBD oil for any purpose. In 2019, Marion County decriminalized the possession of 1 ounce or less of cannabis.
With the exception of Marion County, the possession, cultivation, and sale of any amount of cannabis is against Indiana law. Possession of more than 30 grams of cannabis flower by someone with a prior drug offense is a felony charge that can land an individual up to 2.5 years in prison and up to $10,000 in fines. Individuals with no prior drug offense risk a misdemeanor charge with up to 180 days in jail and up to $1,000 in fines if they are caught with any amount of cannabis flower. When it comes to cannabis concentrates, possession of more than 5 grams is a felony charge that can land an individual up to 2.5 years in prison and up to $10,000 in fines.
At the start of 2022, 13 different bills related to cannabis were filed in the Indiana House and Senate. However, none of these bills advanced out of committee during the legislative session. Currently, there are no bills aimed at further decriminalizing cannabis or legalizing the sale and use of cannabis for medical and recreational purposes in Indiana.
