Weed Legalization in Kansas

Cannabis has been illegal in Kansas since the United States first banned the plant. There have been multiple attempts to legalize medical marijuana in Kansas. All have failed.

In 2015 Wichita voted to decriminalize possession of small amounts of cannabis. The move was challenged by the state’s attorney general. Eventually, the city passed decriminalization again in 2017.

In 2019 Kansas passed SB28 which allowed people medical use of cannabis as a defense in court. If a person was able to obtain CBD oil containing less than 5% THC and was arrested for possession of that oil, they could present a defense at trial claiming that they were using the oil medically. In order to do so, they would need a letter from their doctor recommending the cannabis oil.

In 2021, the Kansas House passed SB158, a bill that would legalize medical marijuana, but the bill died in the Senate. 

As of 2022, the consumption of cannabis is not legal for medicinal or recreational use in the state of Kansas.
