It isn’t possible to get medical marijuana in Kansas yet, though the state is inching toward a legal medical cannabis program. Previous efforts to legalize medical cannabis in the state have stalled in the State Senate.
The state currently allows an affirmative defense for possession of low THC oil when being used for certain debilitating medical conditions. However, the state doesn’t provide for the production or sale of this oil. Patients who are claiming an affirmative defense for low-THC oil use must renew their written doctor’s recommendation every 15 months.
Medical cannabis is not legal in Kansas. The state will establish a list of qualifying medical conditions once medical marijuana is legalized in the state.
Medical cannabis hasn’t arrived in Kansas yet. When lawmakers do legalize medical cannabis, it’s expected that patients will be able to appoint a caregiver to help them purchase and use their medical cannabis. In most states, minor patients are required to have a parent or legal guardian serve as their caregiver.
Currently,parents who have minor children that use low-THC cannabis oil according to a doctor’s recommendation can use an affirmative defense for possession of the low-THC oil. This affirmative defense does not guarantee that the person won’t be arrested or convicted of cannabis possession, but it provides a strong legal defense so long as the defendant follows the requirements of SB 28. A state’s list of qualifying conditions for medical cannabis is usually maintained by the government office responsible for making the rules of the program and running it. In many states that’s either the state’s department of health or a cannabis control board. When Kansas legalizes, if your condition isn’t on the list, it may be possible to petition the office responsible for medical cannabis to have it added.
Once medical cannabis is finally legalized in Kansas, having a medical card will likely be the only way to legally purchase and possess cannabis in the state.
