Recreational cannabis remains illegal in Alabama. The state legalized a limited medical marijuana program in 2021 with the hopes of starting to accept cultivation and processor applications in late 2022. As of mid 2025, the program is still stalled due to ongoing litigation.

What are Alabama’s qualifying conditions?
Each state has their own set of “qualifying conditions” and most don’t need medical proof that you have it. For now, Alabama doesn’t have an active medical cannabis program.

Once the program is fully implemented the qualifying conditions are expected to be:
- Autism Spectrum Disorder (ASD)
- Cancer-related cachexia, nausea or vomiting, weight loss, or chronic pain
- Crohn’s Disease
- Depression
- Epilepsy or a condition causing seizures
- HIV/AIDS-related nausea or weight loss
- Panic disorder
- Parkinson’s disease
- Persistent nausea that is not significantly responsive to traditional treatment, except for nausea related to pregnancy, cannabis-induced cyclical vomiting syndrome, or cannabinoid hyperemesis syndrome
- Post-Traumatic Stress Disorder (PTSD)
- Sickle Cell Anemia
- Spasticity associated with a motor neuron disease, including
- Amyotrophic Lateral Sclerosis (ALS)
- Spasticity associated with Multiple Sclerosis (MS) or a spinal cord injury
- A terminal illness
- Tourette’s Syndrome
- A condition causing chronic or intractable pain in which conventional therapeutic intervention and opiate therapy is contraindicated or has proved ineffective

Due to ongoing litigation over the licensing process, Alabama’s medical cannabis program remains delayed as of mid-2025. The state cannot begin issuing patient cards or allowing physician recommendations until valid business licenses are finalized through the courts. Medical cannabis will only be available to those with a qualifying medical condition and a medical marijuana card.
Alabama’s medical cannabis program isn’t currently active. Once the state starts approving applications and businesses start operations, patients with a medical card will be the only residents eligible for medical cannabis. Recreational cannabis remains illegal in Alabama.
