How to be a medical cannabis caregiver in West Virginia

Some patients choose to have – or are required to have – a designated caregiver who can purchase cannabis on their behalf. They’re also allowed to transport it and prepare it for patient use.

In West Virginia, a caregiver must be designated by the patient or their legal guardian using the West Virginia Caregiver Designation Form, pay the state’s application fee, and submit a criminal history background check. The application will be denied if the designated caregiver has a history of drug abuse, felony possession, sale of controlled substances or drug-related conspiracy.

To qualify as your caregiver, they must:

  • be responsible for the management of the wellbeing of the registered patient concerning their palliative use of cannabis,
  • be at least 21 years of age, although the OMC has the latitude to make exceptions in extremely rare circumstances,
  • for patients under 18 years of age, be a parent or guardian unless it can be demonstrated that “no parent or legal guardian is appropriate or available.”

Caregivers cannot:

  • use the patient’s cannabis,
  • be the patient’s doctor,
  • purchase more than the maximum amount allowed for the patient.

The caregiver application fee is $50. The fee may be waived if the caregiver can demonstrate financial hardship.

Having a medical marijuana card is the only legal way to purchase cannabis in West Virginia. Even after adult-use sales begin in the state, having a med card tends to carry a range of additional benefits, such as lower taxes, higher purchase limits, and greater legal protections.

West Virginia charges a $50 application fee to get a WV medical card. Patients are also responsible for the cost of the required medical evaluation. NuggMD offers low-cost West Virginia medical cannabis evaluations, and there’s no risk because you’re only billed if you’re approved for medical cannabis.

Currently, health insurance does not cover the cost of medical marijuana in West Virginia. Since cannabis remains federally illegal, insurance will not pay for medical marijuana or the costs associated with obtaining a medical marijuana card. This may change in the future if federal laws around cannabis are updated.

Most patients now receive their certification in as little as two to three weeks, though the state of West Virginia notes it can take up to 30 to 60 days to process a certification. You can start the process by getting your seeing a medical marijuana doctor through NuggMD in as little as 15 minutes with no appointment needed. Once approved, your NuggMD medical marijuana doctor will provide your electronic certification within 24 to 48 hours to complete the state registration process.

With NuggMD, you are ONLY charged for your evaluation if you are approved by the doctor. We believe the cost of an evaluation should never be a barrier to getting the care you need.

You’ll only be charged if you’re approved for your medical marijuana certification. If not, your evaluation is free! If you sign up and pay for your evaluation, but then cancel before your evaluation, there is a small $10 fee for the payment processing. You can also change your mind after your evaluation if you wish and request a refund, but you must do so before your certification has been submitted to the state. Once you’ve been certified, a refund for services will no longer be available. Please send an email to support@nuggmd.com with the subject line “Refund Request” and a brief description of your issue. We want to make sure you’re 100% satisfied with your purchase being that you, the customer, are the most important thing to us! Once a refund has been initiated, please allow 3-5 business days for the funds to transfer back to the card you used for the transaction. A refund is no longer available more than 30 days after the date of your evaluation. If any issues arise, please feel free to reach back out for further assistance.

You sure can! You can see any doctor you choose for your renewal evaluation. When you transfer to a NuggMD practitioner, be sure to bring your medical records so they can provide a complete evaluation and best answer your questions.

West Virginia doesn’t have reciprocity agreements with any other states. Every state has different rules for medical marijuana program reciprocity, and you should check with your destination state to confirm if your card can be used while visiting.

Traveling across state lines with cannabis is always prohibited, regardless of your medical cannabis status in one or both states.

Some states recognize out-of-state medical marijuana cards through reciprocity agreements. Before traveling, check the medical marijuana laws in your destination state to see if they accept out-of-state cards. Traveling across state lines with cannabis is illegal under federal law, even if you have a West Virginia medical marijuana card.

You don’t necessarily have to provide a West Virginia ID, but you will need a government-issued ID and proof of WV residency. Here’s a list of approved proof of residency documents.
