How to Get a Medical Marijuana Card in Missouri

About Medical Marijuana in Missouri

Marijuana has been partially decriminalized in Missouri since 2014. Senate Bill 491 made first-time possession of 10 grams or less a non-imprisonable offense and reduced penalties for sale and cultivation. But it wasn't until November 2018 that the state finally had the framework for a comprehensive medical marijuana program.

Amendment 2, Missouri's medical marijuana legalization measure, was approved over two more conservative measures on the same ballot. Amendment 3 would have allowed fewer qualifying conditions, no home cultivation and charged a much higher tax rate of 15%. Proposition C would have been a statutory change instead of a constitutional amendment. It would have taxed cannabis at only 2% but would not have allowed home cultivation either.

Amendment 2, the current law, charges a 4% tax rate, has a broader list of qualifying conditions and allows for home cultivation. It was by far the most liberal choice on the Missouri November 2018 ballot and won by a sound margin. In fact, Amendment 3 got only 32% of the vote and Proposition C got only 44% of the vote. In contrast, 66% of the voters approved the more liberal Amendment 2.

The backbone of the program is still being formed, with new regulations just released and business licenses being issued over the last month of 2019. The first dispensaries are expected to open around March, but there are already thousands of patients registered with the program.

Qualifying Conditions for Medical Marijuana in Missouri

Missouri has a very liberal list of qualifying conditions. In truth, just about anyone with a serious condition can get a medical marijuana card, and this is how the voters intended it to be. As listed under Amendment 2, Missouri's qualifying conditions include but aren't limited to:

  • Glaucoma
  • Epilepsy
  • Cancer
  • Intractable migraines
  • Chronic pain
  • Chronic muscle spasms
  • Debilitating psychiatric disorders
  • HIV or AIDS
  • Hepatitis C
  • ALS
  • Huntington's Disease
  • Crohns
  • Inflammatory bowel disease
  • Neuropathy
  • Autism
  • Cachexia
  • Wasting syndrome
  • Alzheimer's
  • Sickle cell anemia
  • Any terminal illness
  • Any other chronic, debilitating or other medical condition, or
  • Any chronic condition that normally requires prescriptions that could lead to dependence, if the doctor determines that marijuana could be safer and effective.

How to Become a Medical Marijuana Patient in Missouri

Becoming a medical cannabis patient in Missouri is simple! You'll just need to follow a few simple steps. First, go to and answer a few questions and fill out short, simple questionnaire. Next, you'll have a video chat with your new physician. Once your physician has approved you as their patient and emailed your certification to you, you'll finish your state application. It takes just a few days to finish the process and become a fully-legal medical marijuana patient.

How to Become a Patient Caregiver in Missouri

Patients who need help obtaining or administering their cannabis can appoint a caregiver. The process for becoming a caregiver is much the same as applying for a patient identification card. You'll navigate to Missouri's patient application site and click on the blue button that says patient/caregiver application registration. From there, you'll follow the same instructions. 

When inputting the information, the primary caregiver will need to include:

  • The primary caregivers SSN, DOB, and name
  • Residence and mailing address
  • Email address
  • The name and patient license number of the qualifying patient
  • Government issued photo ID

In addition, if the qualified patient is under 18, the caregiver will need to provide proof that they are the parent or legal guardian.

A person can only be a caregiver to three people total in Missouri. The application only costs $25, the same as a patient application, unless the caregiver is seeking to grow cannabis for their patients as well. 

If the caregiver is going to cultivate, then there is an additional charge of $100. Patient caregivers who choose to cultivate will need to describe their cultivation area and security measures in detail on their application. They will also need to be willing to let the Department visit their cultivation facility whenever they choose.

In Missouri, your evaluation will only cost $99. This is an "Early-Bird" discount, that is only available until dispensaries open! At that time, the price will increase to $139.

How much does the state Missouri Patient ID Card cost?

The application fee is $25 for a patient or caregiver. An additional cultivation card costs $100. This fee is in addition to the $25 fee.

What documents do I need to fill out my Oklahoma medical marijuana license application?

You'll need the following documents to apply:

1) Proof of Oklahoma residency, which can be satisfied by one of the following:

  • Oklahoma driver's license or ID
  • Utility bill from the month just before your application (no cell phone or internet bills)

2) Proof of identity, which can be satisfied with one of the following:

  • Oklahoma driver's license or ID

How long does the state have to process my patient identification card application?

Amendment 2 allows the state to take up to 30 days to process your application. If the state doesn't finish processing it by then, your certification will serve as your ID for up to a year. But it's nearly guaranteed that this will never happen. The Department has been very fast with applications up to this point. Some applicants have received their new patient identification cards via email within 48 hours.

Are there discounts for the state license?

Unfortunately no. But Missouri's application fees are much less expensive than most states. For example, in Oklahoma, it costs $100 to apply for a state cannabis ID.

How do I find a doctor that will talk to me about marijuana?

The state doesn't provide a list of doctors who will see patients for medical marijuana evaluations. More doctors are willing to discuss cannabis use now that they are protected from prosecution for discussing cannabis, but it's hard to know for sure if they will be receptive. The doctors who work with NuggMD are knowledgeable about cannabis use and comfortable discussing its potential benefits with patients.

Can a dentist or a nurse practitioner recommend marijuana?

No. Only a state licensed osteopath or physician can write a recommendation for marijuana.

Will health insurance cover my cannabis?

Not yet. Medical marijuana is still federally illegal and insurance companies just won't cover it. Some exceptions are made for Epidiolex, which is federally approved and used for seizures.

Can I use cannabis in public?

No. Specifically, the law says: "No Qualifying Patient shall consume marijuana for medical use in a public place, unless provided by law. Violation of this prohibition shall subject the violator to sanctions as provided by general law."

Can I extract concentrate with butane?

No. You must have a Medical Marijuana-Infused Products Manufacturing Facility License to extract resins using dangerous materials or combustible gasses. You are allowed to use safe methods such as creating cannabis butter or coconut oil extraction or other safe alternatives.

What is NuggMD's refund policy?

You'll only be charged if you're approved for your medical marijuana recommendation. If not, your evaluation is free! You can also change your mind after your evaluation if you wish and request a refund, but you must do so before your certification has been sent to you by your doctor. Once you've received your doctor's certification via email, a refund for services will no longer be available.

What are the qualifying conditions?

Missouri has a long list of qualifying conditions that basically includes anyone with a severe or chronic medical condition:

  • Cancer
  • Epilepsy
  • Glaucoma
  • Intractable migraines unresponsive to other treatment
  • A chronic medical condition that causes severe, persistent pain or persistent muscle spasms, including, but not limited to, those associated with:
  • Multiple sclerosis
  • Seizures
  • Parkinson’s disease
  • and Tourette’s syndrome
  • Debilitating psychiatric disorders, including, but not limited to, post-traumatic stress disorder, if diagnosed by a state licensed psychiatrist
  • Human immunodeficiency virus or acquired immune deficiency syndrome
  • A chronic medical condition that is normally treated with a prescription medication that could lead to physical or psychological dependence, when a  physician determines that medical use of marijuana could be effective in treating that condition and would serve as a safer alternative to the prescription medication
  • Any terminal illness
  • In the professional judgment of a physician, any other chronic, debilitating or other medical condition, including, but not limited to:
  • hepatitis C
  • amyotrophic lateral sclerosis
  • inflammatory bowel disease
  • Crohn’s disease
  • Huntington’s disease
  • autism
  • neuropathies
  • sickle cell anemia
  • agitation of Alzheimer’s disease
  • cachexia
  • wasting syndrome

Under these rules, most residents of the state who are over 18 and seek cannabis treatment will qualify. Parents or guardians who have a minor patient who needs cannabis treatment (if for instance, the child has Dravet's or epilepsy) will need to have their child evaluated and approved by two completely independent, state-licensed physicians.

How much medical marijuana can I possess at a time?

You can possess up to 4 ounces in a 30 day period. If you need more cannabis than this, you'll need a recommendation from two completely independent physicians specifying the higher amount needed.

Can I be fired for using cannabis in Missouri even if I have a medical marijuana card?

Amendment 2, Sec. 7(1)(d) says that cannabis patients can't "bring an action against any employer, former employer, or prospective employer for wrongful discharge, discrimination, or any similar cause of action or remedy based on the employer, former employer, or prospective employer prohibiting the employee, former employee, or prospective employee from being under the influence of marijuana while at work or disciplining the employee or former employee, up to and including termination from employment for working or attempting to work while under the influence of marijuana."

How many patients can a primary caregiver have?

How long will it take for my state Patient Identification Card  to arrive in the mail?

You'll receive your card via email as soon as you're approved. You can then print it out and keep it with you as your ID. Some patients get their cards in as little as 48 hours, but Amendment 2 gives the state up to 30 days to process your application.

Can my doctor deny an organ transplant if I take medical marijuana?

Amendment 2 provides specific protections for organ transplant patients. The law says "No patient shall be denied access to or priority for an organ transplant because they hold a Qualifying Patient identification card or use marijuana for medical use."

Can I use my out-of-state card to buy medical marijuana in Missouri?

No. Missouri doesn't allow purchases with out-of-state cards. The only way you can legally buy marijuana in Missouri is with a Missouri Department-issued patient identification card. However, if you have “equivalent identification card or authorization issued by another state or political subdivision of another state,” you're not supposed to be subject to arrest if you possess less than 4 ounces of marijuana or the equivalent. But you should speak with a lawyer before attempting to do so to make sure your out-of-state card is sufficient to protect you in Missouri.

If I have a caregiver that cultivates for me, can I cultivate also?

No. Only you or your caregiver can cultivate your cannabis.

How many plants can I cultivate/grow?

You can only cultivate marijuana if you get approval to do so. There is a $100 application fee to cultivate, in addition to the $25 patient application fee.

If and when you are approved, you'll receive special paperwork that you need to keep with your plants. You'll need to stay within the limits because growing more than the limit will have severe legal consequences. Your cultivation must take place in a locked room and you must follow the security measures you agreed to when you have the department your cultivation plan.

Up to two people can share the same cultivation space IF they both have cultivation approval. The facility can also be used to cultivate for one more person IF one of the patients also has a caregiver license to cultivate for another patient.

The limits are as follows:

  • 1 patient with cultivation license: 6 mature plants/ 6 immature plants/ 6 seedlings TOTAL
  • 2 patients, both with cultivation license: 12 mature plants/ 12 immature plants/ 12 seedlings TOTAL
  • 2 patients with cultivation & 1 is a caregiver: 18 mature plants/ 18 immature plants/ 18 seedlings TOTAL

18 is the absolute maximum number of plants that can be cultivated in a single facility, and each set of six plants must be assigned to a specific person with the paperwork displayed for each patient.

Does Missouri charge taxes on cannabis purchases?

Yes. Missouri will be requiring all retailers to charge a 4% tax on all cannabis purchases. This tax is in addition to any other applicable taxes and fees.

Can I get a cannabis card if I have a criminal record?

Yes. A criminal record doesn't prevent you from obtaining a cannabis card in Missouri. You can be denied if you provide false information or an incomplete application. You can also be revoked if you break the rules of the program, possess more than you're allowed, or you sell or traffic cannabis.
