Qualifying conditions in South Dakota

A "debilitating medical condition," defined as "a chronic or debilitating disease or medical condition or its treatment that produces one or more of the following:

  • cachexia or wasting syndrome 
  • severe, debilitating pain 
  • severe nausea 
  • severe and persistent muscle spasms, including those characteristic of multiple sclerosis
  • seizures

How to be a medical cannabis caregiver in South Dakota

Medical cannabis patients in South Dakota may opt to have a designated caregiver to help them with their medical cannabis treatment. Minors are required to have a parent or guardian act as their primary caregiver.

Caregivers will receive an email notification to create an account once the patient has completed their application and submitted it to the state. The caregiver will follow the instructions and complete their portion of the application via the online portal. They are required to complete a background check and pay the required fees.

To qualify as your caregiver, they must:

  • be at least 21 years old
  • Agree to assist the qualifying patient
  • Complete a background check
  • Complete the required application
  • Pay the fee

Caregivers cannot:

  • Assist more than five patients at a time
  • Have been convicted of a felony

The caregiver application fee is $20.

To register for a medical cannabis card in South Dakota you’ll need to visit your doctor first. If he approves your qualifying medical condition for cannabis treatment, they’ll submit a recommendation via an online portal to the state.

  • South Dakota residents with qualifying medical conditions and a licensed doctor's recommendation are eligible for the medical marijuana program.

  • Most states offer a process by which patients can petition the state to request a condition be added to the list of qualifying conditions. To learn more, visit the South Dakota state cannabis program.

  • Having a medical cannabis card is currently the only way to access legal medical cannabis in South Dakota.

  • It costs $75 to submit a patient application, $20 to add a caregiver, and additional fees if a cultivation permit is requested. Low-income options are available to patients who qualify. Fees relating to your doctor's visits are dependent upon your medical health care coverage.

  • Cannabis is still federally illegal, so many health insurance companies will not cover the costs associated with medical cannabis care.

  • NuggMD does currently not offer its services in South Dakota. Most states respond to submitted applications within 30 days, though some can take up to 90 days.

  • With NuggMD, you are ONLY charged for your evaluation if you are approved. We believe everyone deserves access to a qualified medical cannabis doctor, and the cost of an evaluation shouldn’t be a barrier.

  • You'll only be charged if you're approved for your medical marijuana certification. If not, your evaluation is free! If you sign up and pay for your evaluation, but then cancel before your evaluation, there is a small $10 fee for the payment processing. Once you've been certified, a refund for services will no longer be available. Please send an email to support@nuggmd.com with the subject line “Refund Request” and a brief description of your issue. We want to make sure you're 100% satisfied with your purchase being that you, the customer, are the most important thing to us! Once a refund has been initiated, please allow 3-5 business days for the funds to transfer back to the card you used for the transaction. A refund is no longer available more than 30 days after the date of your evaluation. If any issues arise, please feel free to reach back out for further assistance.

  • NuggMD is not available in South Dakota yet. You can see any state-approved practitioner to assess your qualifying condition and discuss medical cannabis treatment.

  • This depends on the state to which you’re traveling. Each state has different rules regarding reciprocity, and some don’t allow it at all. Check with your destination state to learn more.

  • South Dakota requires that you submit a copy of your valid government-issued ID or Driver's license and passport.
