How to be a medical cannabis caregiver in West Virginia

Some patients choose to have – or are required to have – a designated caregiver who can purchase cannabis on their behalf. They’re also allowed to transport it and prepare it for patient use.

In West Virginia, a caregiver must be designated by the patient or their legal guardian using the West Virginia Caregiver Designation Form, pay the state’s application fee, and submit a criminal history background check. The application will be denied if the designated caregiver has a history of drug abuse, felony possession, sale of controlled substances or drug-related conspiracy.

To qualify as your caregiver, they must:

  • be responsible for the management of the wellbeing of the registered patient concerning their palliative use of cannabis,
  • be at least 21 years of age, although the OMC has the latitude to make exceptions in extremely rare circumstances,
  • for patients under 18 years of age, be a parent or guardian unless it can be demonstrated that “no parent or legal guardian is appropriate or available.”

Caregivers cannot:

  • use the patient’s cannabis,
  • be the patient’s doctor,
  • purchase more than the maximum amount allowed for the patient.

The caregiver application fee is $50. The fee may be waived if the caregiver can demonstrate financial hardship.

Frequently asked. Frequently answered.

To qualify for a medical marijuana card in West Virginia, you must show proof of residency, be at least 18 years of age (minors can join the program with the approval of a parent or guardian), and receive a physician’s certification for one of the state-qualifying medical conditions.

Qualifying conditions for medical marijuana in West Virginia include cancer, epilepsy, chronic pain, PTSD, multiple sclerosis, and more. If you aren’t sure if your condition qualifies, consider speaking with a registered physician in the state to learn more. At NuggMD, you can meet with a qualified practitioner in as little as 15 minutes, and you only pay for your evaluation if you’re approved.

Having a medical marijuana card is the only legal way to purchase cannabis in West Virginia. Even after adult-use sales begin in the state, having a med card tends to carry a range of additional benefits, such as lower taxes, higher purchase limits, and greater legal protections.

The state application fee is $50, with potential waivers for financial hardship. Patients are also responsible for the cost of the required medical evaluation. Physician consultation fees can vary; NuggMD offers affordable evaluations with zero hidden costs, and you only pay if you’re approved for medical cannabis.

Currently, health insurance does not cover the cost of medical marijuana in West Virginia. Since cannabis remains federally illegal, insurance will not pay for medical marijuana or the costs associated with obtaining a medical marijuana card. This may change in the future if federal laws around cannabis are updated.

Most patients now receive their certification in as little as two to three weeks, though the state can take 30 to 60 days to process your application fully.

You can start the process by speaking with a NuggMD medical cannabis doctor in as little as 15 minutes — no appointment needed. If approved, your doctor will submit your electronic certification within 24-48 hours so you can complete your state registration.

There is no script to access medical cannabis, and the decision is up to your practitioner. During your consultation, provide an overview of your medical history and current symptoms. Discuss how your condition affects daily life and the previous treatments you’ve tried. Honest communication helps the physician assess if medical cannabis is appropriate. NuggMD offers confidential online consultations with licensed West Virginia doctors who are passionate about helping patients access the care they need.

No, only registered medical cannabis patients with a valid West Virginia medical cannabis card can purchase products from licensed dispensaries. Recreational cannabis is not legal in the state.

Many West Virginia dispensaries offer online ordering for in-store pickup, though at-home cannabis delivery is prohibited. Patients can browse menus and place orders online through dispensary websites or platforms like Weedmaps.

West Virginia law explicitly prohibits employers from discriminating against medical cannabis patients. However, employers aren’t required to accommodate cannabis use at work. If your job involves safety-sensitive duties or drug testing, consider discussing your medical cannabis use with your employer.

With NuggMD, you are ONLY charged for your evaluation if you are approved by the doctor. We believe the cost of an evaluation should never be a barrier to getting the care you need.

You’ll only be charged if you’re approved for your medical marijuana certification. If not, your evaluation is free! If you sign up and pay for your evaluation, but then cancel before your evaluation, there is a small $10 fee for the payment processing. You can also change your mind after your evaluation if you wish and request a refund, but you must do so before your certification has been submitted to the state. Once you’ve been certified, a refund for services will no longer be available. Please send an email to support@www.nuggmd.com with the subject line “Refund Request” and a brief description of your issue. Patients won’t receive a refund for failure to follow through with their certification process once the practitioner completes the certification requirements. It is the patient’s responsibility to complete their certification. If you’re stuck or having trouble completing your certification, please reach out to customer service and our agents will help you through the process. We want to make sure you’re 100% satisfied with your purchase being that you, the customer, are the most important thing to us! Once a refund has been initiated, please allow 3-5 business days for the funds to transfer back to the card you used for the transaction. A refund is no longer available more than 30 days after the date of your evaluation. If any issues arise, please feel free to reach back out for further assistance.

You sure can! You can see any doctor you choose for your renewal evaluation. When you transfer to a NuggMD practitioner, be sure to bring your medical records so they can provide a complete evaluation and best answer your questions.

West Virginia cannabis laws don’t currently allow dispensaries to accept medical cards from other states. Every state has different rules for medical marijuana program reciprocity, and you should check with your destination state to confirm if your card can be used while visiting.

Traveling across state lines with cannabis is always prohibited, regardless of your medical cannabis status in one or both states.

Yes, West Virginia medical cardholder may be able to purchase cannabis products from a licensed dispensary in states that offer reciprocity. Always check the specific laws of the state you’re visiting, as not all states accept out-of-state med cards.

You don’t necessarily have to provide a West Virginia ID, but you will need a government-issued ID and proof of WV residency. Here’s a list of approved proof of residency documents.
