Minnesota legalized medical cannabis in 2014 and, in 2023, legalized the possession and cultivation of adult-use cannabis for individuals over 21 Individuals with a qualifying condition can obtain a physician's recommendation and register with the state Medical Cannabis Registry to purchase medical cannabis from a dispensary. Currently, the Minnesota legislature does not have any bills related to the legalization of adult-use cannabis awaiting a vote.

Weed Legalization in Minnesota

As of February 2024, the consumption of cannabis is legal for medicinal or recreational use in the state of Minnesota. 

Minnesota was the 22nd state to legalize the use of medical marijuana in 2014. Under this law, individuals with a qualifying condition are permitted to get a physician’s recommendation and apply with the state to purchase medical cannabis from a state-licensed dispensary. 

In 2021, as part of an omnibus health bill, the Minnesota state legislature approved the sale and use of cannabis flower for medical marijuana patients (under the 2014 law, patients were limited to cannabis in liquid, oil, and pill form). Currently, the state of Minnesota has over 44,700 medical marijuana patients

On May 30th, 2023, Minnesota Governor Tim Walz signed House File 100 into law, becoming the 23rd state to legalize adult-use cannabis. Effective August 2023, adult-use cannabis in Minnesota became legal for adults 21 and over for possession and cultivation. Retail sales are expected to start at the beginning of 2025.

Where to Buy Legal Weed in Minnesota

Beginning in August of 2023, Minnesota residents 21 and older may possess, use, and cultivate cannabis.

When Minnesota’s recreational dispensaries open in 2025, adult-use consumers will be subject to a 10% Cannabis Tax, the state sales tax of 6.875%, and local tax rates. Medical cannabis patients are exempt from all taxes. Products purchased from dispensaries on an Indian Reservation will not be subject to the 10% Cannabis Tax.

The 10% Cannabis Tax will be split 80/20, with 80% going to the state’s general fund and 20% to local government aid.

Medical cannabis patients 18 and older can access one of Minnesota's medical cannabis dispensaries. There are two open dispensaries on tribal reservation land from which adult-use consumers can purchase products from: Native Care on Red Lake Nation and Waabigwan Mashikiki on White Earth Nation.

Is Cannabis Delivery Available in Minnesota?

NO, marijuana delivery is not available for either medicinal or recreational purposes in the state of Minnesota.

Cannabis can be legally used in the following areas in Minnesota:

🗹 Private property whose owners permit use and private residences (Effective March 1st, 2025, smoking or vaping adult-use cannabis products will be prohibited in a multifamily housing building, including patios and balconies.)

🗹 Public places where smoking and vaping are permitted.

Cannabis CANNOT be consumed in:

X Public spaces where smoking and vaping are prohibited under the Minnesota Clean Air Act (indoor public places, public meetings, places of employment, and public transportation).

X Locations where the smoke, aerosol, or vapor of a cannabis product could be inhaled by a minor.

X Federally subsidized housing. Due to the federal prohibition of cannabis, the U.S. Department of Housing and Urban Development (HUD) does not have the discretion to admit or retain users of cannabis (i.e., marijuana), including medical cannabis, to the public housing program.

X Heavy machinery or equipment.

X Vehicles, either in motion or parked, for both driver and passengers.

What are the Restrictions on Cannabis Possession in Minnesota?

Although adult-use dispensaries aren’t set to open until 2025, adults 21 and over can possess up to two ounces of cannabis flower in public, possess up to two pounds of cannabis flower at home, possess up to 8 grams of concentrate, and up to 800mg of THC in an edible. Adults 21 and over are also permitted to gift the legal limits to an individual over the age of 21.

Minnesota medical cannabis patients 21 and older, along with non-medical patients 21 and over, are permitted to grow up to four mature and four immature cannabis plants at a single residence. These plants must be locked in an enclosed space that is not viewable by the public.

Individuals with a Minnesota medical marijuana card can purchase up to a 30-day supply of cannabis products in a 23-day period from a state-licensed dispensary, not to exceed 450 grams of dried cannabis flower per visit. The dispensary pharmacist determines the daily dosage limit for patients, which is calculated based on the 90-day maximum recommended amount. For amounts over 450 grams, the physician must justify the amount to the commissioner and get approval.

During vehicular transportation:

  • Cannabis may either be in a sealed container, or
  • Stored in the trunk of the vehicle
