Time’s Running Out for Cannabis Rescheduling Comments

public comment period
By Deb Tharp Published July 1st

The recent SCOTUS decision overturning the Chevron Doctrine has likely thrown a wrench into rescheduling, but it's still absolutely vital to comment on the DEA's proposal to reschedule. The feds are required by law to analyze these comments and consider them in the regulatory process, so this is the one time your voice is guaranteed to be heard by federal officials.

As of this writing, we have barely more than two weeks to register our praise or grievances with the fed's plans for our favorite plant, so time is of the essence.

In light of this short deadline and the fact that many don't know how to participate in the rulemaking process, here are step-by-step instructions for commenting on the cannabis rescheduling proposal. The comment period closes on 7/22/2024.

Step 1: Visit the Federal Register Website

Open your web browser and go to www.federalregister.gov. On the homepage, locate the search bar at the top of the page.

Step 2: Search for the Proposal

Enter the register number "2024-11137" into the search bar and press enter.

Step 3: Access the Proposal

In the search results, find the listing for the cannabis rescheduling proposal (2024-11137). Click on the title of the proposal to open the detailed view.

Step 4: Locate and Click the Comment Button

The comment button is the first option in the grey bar on the left-hand side. Click this button.

Step 5: Open the Comment Submission Form

You'll see a pop-up box. Check the acknowledgment and click "continue."

Step 6: Fill Out the Comment Form

Enter your comment in the provided text box. Be clear and concise when expressing your views.  Fill in any required fields, such as your name and contact information. You can choose to submit your comment anonymously as well. If you choose to submit anonymously, don't include personally identifying information in your comment.

Step 7: Attach Supporting Documents (Optional)

If your comment is longer than what's allowed in the box, you can attach a document with a longer comment if you wish, or even pictures, documents, and other evidence to support your statement. This step is optional, and most commenters simply choose to leave a text statement in the comment box as shown above.

Step 8: Submit Your Comment

Once you are satisfied with your comment, click the "Submit" button.

Step 9: Write Down Your Tracking Number (Optional)

You will receive a confirmation notice indicating that your comment has been successfully submitted. If you want to keep it for your records, you can write down your tracking number and keep it in a safe place.

This is your chance to tell the government how you want cannabis regulated in the future. Even if the rescheduling proposal is defeated by a legal challenge, your comments and opinions will be on record so the feds know and understand where you stand on cannabis reform. Remember, the comment period ends on Jul 22, 2024, so make sure to submit your comments before the deadline.
